These Communications Terms explain the email, text-message, telephone, and portal communications you may receive from Westward Science and care-related organizations. They supplement the Terms of Use and Privacy Policy.
1. Communication Categories
We separate communications by purpose:
- Service and account communications: receipts, security alerts, requested support, order status, policy notices, and other non-promotional account messages.
- Care communications: intake follow-up, appointment information, clinician or pharmacy messages, adherence reminders, and treatment-related support.
- Marketing communications: promotions, product announcements, offers, and other commercial messages that are not necessary to provide requested care or complete a transaction.
Consent to one category does not automatically constitute consent to another.
2. Service and Account Communications
When you provide contact information or make a transaction, we may send communications reasonably necessary to service your account, protect security, provide legally required notices, or respond to you. You may not be able to opt out of essential account or transaction messages while the account or transaction remains active.
3. Care-Related Text Messages
If you separately consent to care-related text messages, you authorize Westward Science and the identified care participants to send messages at the number you provide. Messages may be sent using automated technology. Message frequency varies. Message and data rates may apply.
Care-related text consent identifies the sender or sender category, brand, sending number or code, purpose, expected frequency, HELP and STOP routes, and a secure alternative. Care consent is not reused for promotional content.
Text messaging is optional and is not a condition of receiving treatment. Reply STOP to stop text messages from the sending number and HELP for help. You may also contact care@malibuprotocol.com. A STOP request may not opt you out of messages from a different identified sender; each sender must honor the revocation rules that apply to it.
Stopping text messages does not cancel care, an order, or a subscription. It may require us to use another secure or practical contact method for important care information.
4. Marketing Text Messages
Marketing texts require a distinct, optional, unchecked consent that identifies the seller. Consent to marketing texts is not a condition of purchase or care. The consent shown at collection will state the expected message frequency, automated-technology disclosure, message/data-rate notice, and STOP/HELP instructions.
We will honor a valid revocation made by a reasonable method required by law. We may send one non-promotional confirmation that the opt-out was processed.
5. Email
We may send transaction and care-related email as described above. Marketing email will identify the sender, include a valid postal address, and provide an unsubscribe method. We will process commercial-email opt-outs within the time required by law.
Unsubscribing from marketing email does not stop essential transaction, security, legal, or care communications.
6. Telephone and Voicemail
When permitted by your choices and applicable law, we or an identified care participant may call the number you provide. Tell us if a number is shared, is no longer yours, or should not receive voicemail containing care information.
Marketing calls using prerecorded or artificial voice or automated dialing technology require any consent mandated by law and will be kept separate from consent to receive care.
7. Privacy and Security Limits
Ordinary text and email may not be encrypted and can be viewed by anyone with access to your device or account. Do not use ordinary text or email for emergencies or send detailed medical information unless instructed to use a secure channel.
We will minimize sensitive content in notification previews and ordinary messages. Clinical records and detailed care communications should remain in the secure system designated by the provider.
Call 911 for an emergency. Communications channels are not continuously monitored and do not replace emergency services.
8. Your Responsibilities
You agree to provide accurate contact information, keep it current, and protect access to your devices and accounts. If you provide a telephone number, you represent that you are authorized to receive communications at that number. Notify us promptly if the number changes or is reassigned.
9. Records of Consent and Revocation
We will retain records of the exact consent language shown, document version, timestamp, channel, source page, user or transaction identifier, and subsequent opt-outs or revocations. These records help us honor your choices and comply with law.
