This policy explains charges presented through Malibu Protocol, when recurring charges may occur, and how cancellations and refunds work. The final checkout must identify the seller, medical provider, Pharmacy, merchant of record, and refund obligor for each charge component. It is part of the Westward Science Terms of Use.
1. What You May Be Charged For
At initial launch, checkout presents the complete price for the selected treatment program. That price may include:
- clinician review and program support;
- prescription medication and pharmacy fulfillment;
- shipping; and
- any taxes or other amounts disclosed before you authorize payment.
The checkout screen identifies the complete authorization amount and whether the patient selected monthly or quarterly prepaid pricing. Initial launch has no separate consultation, visit, cancellation or processing fee if no prescription is issued.
2. Prescription and Fulfillment Are Not Guaranteed
Payment does not guarantee that a clinician will prescribe a medication or that a pharmacy will dispense it. Clinical decisions are made independently by the licensed provider. Pharmacy fulfillment remains subject to a valid prescription, pharmacy review, availability, applicable law, and delivery eligibility.
If a prescription is not issued, the complete authorization is released and no consultation or visit fee is captured. Release timing on the patient's account is controlled by the patient's financial institution.
3. Authorization and Receipts
By submitting payment information, you authorize the merchant or collection agent identified at checkout and its processor to make the disclosed one-time and, if applicable, recurring charges. The responsible merchant will provide a retainable confirmation showing the charge components, seller/provider, material payment terms, cancellation method, and customer-support contact.
We place a temporary authorization hold after the intake and before clinician review. A hold is not a completed charge. We capture the complete selected plan price only after an authenticated clinical outcome confirms a prescription.
3A. Uninsured and Self-Pay Estimate Rights
The Provider Group—not Westward checkout copy—must determine and satisfy any federal or state duty to provide an uninsured or self-pay patient a Good Faith Estimate for Clinical Services. The final flow must identify the responsible Provider Group, deliver any required estimate in a retainable form before care, and explain the applicable patient-provider dispute process. A price shown for a Malibu Protocol program does not replace a Provider Group estimate required by law.
4. Initial Launch Has No Automatic Renewal
Monthly and quarterly describe the selected initial payment option. Monthly is one first-month payment. Quarterly is one discounted three-month prepaid payment. Neither option creates a Stripe subscription or authorizes an off-session automatic renewal at initial launch.
Until a separately approved recurring program is available, a future treatment period requires a new affirmative payment authorization.
4A. Future Recurring Programs
If you enroll in a recurring program, the checkout will clearly disclose before you consent:
- the amount or a clear method for determining it;
- the billing or shipment frequency;
- the duration of the initial term, if any;
- whether and how the program renews;
- any minimum commitment;
- how to cancel; and
- material conditions affecting a promotional price or trial.
Recurring enrollment requires a separate affirmative action. It will not be inferred from acceptance of the general Terms or from consent to receive care. After enrollment, we will send a retainable acknowledgment containing the renewal terms and a cancellation method.
Unless a fixed term is clearly disclosed, a recurring program continues until you cancel. We will provide any renewal, trial-ending, or material price-change notice required by applicable law before the affected charge.
5. Six-Month Prescription Release Programs
Some clinician-authorized treatment plans may permit a pharmacy to release medication in monthly shipments under an authorization lasting up to six months. This clinical authorization is not permission for Westward Science to charge you indefinitely.
For any such program, the checkout and account will separately disclose:
- the number and expected timing of shipments;
- the amount charged per shipment or billing period;
- when a new clinical review is required;
- the deadline to skip, pause, or cancel a future shipment;
- circumstances in which a pharmacy or clinician may pause treatment; and
- whether already-prepared or already-shipped medication can be refunded.
Westward Science will obtain a new payment authorization or provide any notice required by law before beginning a renewed course.
6. How to Cancel
You may cancel a recurring program through your member portal or by contacting care@malibuprotocol.com. The online cancellation method is reasonably easy to find and use and does not require a telephone call.
Cancellation stops future recurring charges after the cancellation takes effect. It may not reverse a charge already incurred for clinician services or patient-specific medication already accepted for preparation by a pharmacy. The cancellation confirmation will state the effective date and the status of any pending shipment.
If clinical safety requires follow-up or a supervised transition, cancellation of billing does not replace medical advice. Contact your provider about safely changing or stopping treatment.
7. Refund Rules
Subject to applicable law:
- Before clinician engagement: If you cancel before clinician review begins, we will refund all captured amounts for unperformed services and unfulfilled products.
- After clinician engagement but before a prescription is issued: The complete authorization is released and no consultation or visit fee is captured.
- No prescription issued: The complete authorization is released.
- After pharmacy acceptance or preparation begins: Patient-specific prescription products generally cannot be returned or resold. Refunds remain available where required by law and for pharmacy error, wrong product, verified damage, or non-delivery.
- Duplicate or unauthorized charge: Contact us promptly. We will investigate and correct confirmed billing errors.
- Shipping problem: Follow the Shipping and Fulfillment Policy. Do not use a product that appears damaged, incorrect, tampered with, or compromised.
Refunds are issued to the original payment method unless law requires another method. Financial institutions control when a refund appears.
8. Price Changes
We may change prices prospectively. A new price will not be applied to a recurring charge until we provide any advance notice and obtain any consent required by law. Continuing to receive clinical care does not by itself constitute consent to a higher recurring price.
9. HSA and FSA Payments
Eligibility and tax treatment depend on your plan and circumstances. Westward Science does not guarantee that an HSA/FSA card will be accepted or that a purchase will be reimbursed, and does not provide tax advice. Confirm eligibility with your plan administrator.
10. Chargebacks
Please contact care@malibuprotocol.com first so we can investigate a disputed charge. Nothing in this section limits your rights with your card issuer or under applicable law.
